Terms of Service

1. Introduction

Welcome to MMM Pilot™. Use of the platform is governed by these Terms. The service is provided by Can Go Digital L.P. (VAT 802840569, Kallithea, Greece). By registering, you fully accept these terms. MMM Pilot serves as a cloud-native orchestration layer for the Facebook Robyn framework, designed to democratize access to advanced marketing econometrics.

2. Service Description & Functional Scope

MMM Pilot is a B2B SaaS application providing automated Marketing Mix Modeling (MMM) analysis. It functions as a streamlined wrapper for the Robyn framework, optimized for usability and automation.

  • Core Functionality: The service processes marketing data to build models using Weibull PDF adstock transformation and allows for hyperparameter configuration.
  • Future Functionality: Your subscription and use of the Service are based solely on the features and functionality currently available. Your purchase is not contingent on the delivery of any future functionality or features mentioned in public roadmaps, oral comments, or sales presentations.

Platform Restrictions

By using the service, you acknowledge the following functional constraints:

  • Runtime Limit: Data processing is strictly limited to a maximum duration of 8 hours per run.
  • Unsupported Features: The platform does not currently support Geometric Adstock, Weibull CDF, Geo-Lift experiments, or Model Calibration against external ground-truth studies.
  • No Iterative Refresh: Model “refreshes” are not supported. Adding new data requires configuring and executing a completely new analysis run.

3. Billing, Payments & Merchant of Record

The service operates on a “Credits” system, where credits are consumed based on the execution of model analysis (“Runs”).

Merchant of Record (Reseller)

Our order process is conducted by our online reseller, Lemon Squeezy (Lemon Squeezy, LLC). Lemon Squeezy is the Merchant of Record for all our orders.

  • Liability: By purchasing a subscription or credit package, you enter into a transaction with Lemon Squeezy. They are responsible for processing your payment, calculating and remitting global sales tax/VAT, and issuing your invoice/receipt.
  • Bank Statement: Charges on your bank statement will appear as “Lemon Squeezy” or “LemonSqueezy.com”, not MMM Pilot.
  • Disputes: Any payment-related inquiries or disputes are subject to the Lemon Squeezy Terms of Service and Privacy Policy.

Credit Expiration Policy

  • Subscription Credits: Credits included in monthly “Pilot” or “Navigator” subscriptions expire at the end of each billing cycle.
  • Refuel Credits: Add-on credit packages (“Refuel”) contain non-expiring credits that remain in your account until used.

Charge on Success

  • Consumption: Credits are deducted from your balance only upon the successful completion of a model Run.
  • Run Failures: If a Run fails for System Errors (e.g., timeout beyond 8 hours), no credits are consumed. However, run failures caused by User Data Errors (e.g., malformed CSVs, insufficient data points, incorrect formatting) are not grounds for monetary refunds, though credits reserved for that run will be returned to your balance.

Refund Policy

  • Service Refunds: Monetary refunds for purchased Credit packages are generally only granted in the event of a technical inability of the platform to provide the service for a period exceeding 48 hours.
  • Processing: While MMM Pilot defines this policy, all refund requests must be processed technically through the Lemon Squeezy platform. Lemon Squeezy reserves the right to issue refunds at their discretion in accordance with their own Marketplace Terms (typically within a 60-day window) to prevent payment disputes.

4. Intellectual Property & Data Rights

  • The Platform: The software, source code, orchestration logic, and MMM Pilot trademark are the exclusive intellectual property of Can Go Digital L.P.
  • Your Data (Ownership): You retain exclusive ownership of the specific input data (CSVs) and the generated reports/artifacts.
  • Benchmarking License: While you retain ownership of your specific input data, you grant MMM Pilot a perpetual, non-exclusive, royalty-free license to create aggregated, anonymized, and de-identified data sets (“Benchmarking Data”) derived from your inputs. MMM Pilot owns all right, title, and interest in this Benchmarking Data for the purpose of improving service algorithms and creating industry benchmarks.
  • Prohibited Data (“Clean Room” Policy): You acknowledge that the Service is intended for aggregated marketing data only. You strictly agree NOT to upload any “Barred Data,” defined as Personally Identifiable Information (PII), health data, financial account numbers, or government IDs. MMM Pilot expressly disclaims any liability for Barred Data uploaded in violation of this clause.

5. AI Disclaimer & Methodology

MMM Pilot utilizes the Robyn statistical framework and Artificial Intelligence to generate estimates and assist in decision-making.

  • Third-Party AI Services: The Platform leverages third-party artificial intelligence models (e.g., Google Gemini) for model selection and interpretation. You acknowledge that these Third-Party AI Services are not under the control of MMM Pilot. We are not responsible for any output generated by these services, including hallucinations, inaccuracies, or bias. You are solely responsible for reviewing all AI-generated advice.
  • AI-Driven Selection: The “Best Model” selection feature utilizes Generative AI as a heuristic convenience to reduce cognitive load. This is not a statistically derived validation metric.
  • Hyperparameter Tuning: AI-suggested hyperparameter ranges are estimates. Blindly accepting these suggestions without review may lead to overfitting, where the model memorizes historical noise rather than learning predictive signals.
  • No Financial Advice: Can Go Digital L.P. does not provide financial or investment advice. We do not guarantee specific results (e.g., sales increase). The responsibility for business decisions and budget allocation rests solely with you.

6. Publicity Rights

You grant MMM Pilot a limited, revocable right to use your company name and logo as a reference for marketing or promotional purposes on our website and in other public or private communications with our existing or potential customers. You may revoke this right at any time by sending a written request to support@mmmpilot.com.

7. Limitation of Liability

To the maximum extent permitted by Greek law, Can Go Digital L.P. shall not be liable for any indirect damages, lost profits, data loss, or business interruption arising from the use of the service.

  • Infrastructure: We are not liable for run failures caused by data complexity exceeding the 8-hour processing limit.
  • Total Liability: Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim.

8. Account Termination & Data Retention

We reserve the right to suspend or terminate your access if you violate these terms (e.g., reverse engineering attempts, use of stolen credit cards).

  • Post-Termination Data Retention: Upon termination of your account, MMM Pilot may retain your data for a grace period of 30 days to allow for account reactivation or data retrieval. After this period, we reserve the right to permanently delete all Customer Data associated with your account without further notice.

9. Governing Law

These terms are governed by Greek Law. The courts of Athens are designated as exclusively competent for any dispute.
